USER AGREEMENT: These Terms and Conditions (hereinafter referred to as the “Terms””) / This User Agreement (hereinafter referred to as the “Agreement”) is entered between you, as a user of the website, (hereinafter referred to as “you and/or user”) and Mera Mann Foundation, (hereinafter referred to as “Mera Mann”), having its corporate office at 16, Aaram Nagar-2, Versova Beach Road, Versova, Andheri West, Mumbai 400061, Maharashtra, India their website www.meramannfoundation.org

(Hereinafter for brevity sake both services and website www.meramannfoundation.org together referred to as the ‘website’)

USE OF WEBSITE: This website (www.meramannfoundation.org) is developed, owned and maintained by Mera Mann Foundation. The following TERMS apply to the use of this website. These TERMS may be further revised without notice as per specific TERMS through changes made herein from time to time. The Privacy Policy, which is also displayed on the ‘website’, should be read in conjunction with the TERMS listed herein and is deemed to form a part of these TERMS. In case of contradiction, the terms in the respective document would be deemed correct and applicable, and in all other situations, the TERMS mentioned here would be applicable.

SECTION 1 – ONLINE THERAPY TERMS

A. By accessing the website, you warrant and represent to the website owner that as a therapist you are legally entitled to do so and to make use of information made available via the website for the purpose of conducting therapies for Mera Mann strictly.

B. If you are a client seeking therapy/therapies, you warrant and represent to the website owner that you understand the processes and risks involved in obtaining therapies. It shall be your responsibility to disclose any underlaying conditions to the therapist before availing any therapies through Mera Mann platform. Mera Mann is an intermediary and it does not take any warranty or responsibility for the therapy or the process/processes involved.

C. You may not use our services for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction. 

SECTION 2 – GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time. 
You understand that your information (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. 

You agree not to misuse, abuse or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. 

Content posted by Mera Mann in our video gallery is an exclusive copyright of Mera Mann foundation. Content shared by therapists and clients is not the responsibility of Mera Mann. Further, the gallery contains videos from experts, celebrities and clients. The views expressed in those videos are the views of those experts and Mera Mann does not endorse them. They are for information purpose only. Any violation or infringement of any intellectual property rights shall be borne by the person posting the same. Mera Mann shall be indemnified by the author for any liability arising out of any such violation. 

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 3 – ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or timelier sources of information. Any reliance on the material on this site is at your own risk. 

This site may contain certain research material and papers. This research material and papers may contain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. Certain therapies or services may be available exclusively online through the website. These therapies or services may have limited slots and are subject to availability and connectivity of both the therapists and the clients. Mera Mann will not be responsible for any technical glitch at any point during the course of services.

We have made every effort to display as accurately as possible the therapies and therapists empanelled with Mera Mann. We rely on the information provided by the therapists and the clients. In case of therapists, we do the regular due diligence for their qualifications, credentials and background check.

We reserve the right, but are not obligated, to limit the availability of our therapies or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the accessibility of any therapies or services that we offer. All descriptions of therapies are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any service at any time. Any offer for any therapies or service made on this site is void where prohibited. 

We do not warrant that the quality of any therapies, services or information obtained by you will meet your expectations, or that any errors in the Service/therapies will be corrected.

SECTION 6 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any therapy you avail with us. We may, in our sole discretion, limit or cancel your request altogether. In the event that we make a change to or cancel a therapy or service, we may attempt to notify you by contacting the e-mail and/or phone number provided at the time the request was placed. We reserve the right to limit or prohibit therapies or services that, in our sole judgment, appear to be placed by someone with certain physical or mental conditions that fall outside the purview of our work and ethics.

You agree to provide current, complete and accurate contact information for all therapies and services obtained on our website. You agree to promptly update your personal and other information, including your email address and contact information, so that we can complete your therapies and contact you if and as needed.

The service and all therapies and services provided to you through the website are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of therapy processes, result for a particular purpose, impact and implementation. In no case shall Mera Mann, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any therapies availed using the service, or for any other claim related in any way to your use of the service or any therapy, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or therapy) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold Mera Mann, its officers, directors, employees, agents, licensors, therapists, interns, affiliates and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms of Use.

SECTION 14 – SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. 

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 16 – ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). 

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 17 – GOVERNING LAW AND JURISDICTION

This Agreement is governed by and is to be construed in accordance with the laws of the Republic of India. Any suit, action or proceeding seeking to enforce any provisions of, or based on any matter arising out of or in connection with, this Agreement or the Transactions may be brought in a court sitting in Mumbai, India, and each of the Parties hereby consents to the non-exclusive jurisdiction of such courts.

SECTION 18 – ARBITRATION: 

In case of any dispute or difference arising out of or connected with or relating to this Agreement the same shall be referred to arbitration under Arbitration and Conciliation Act, 1996 or any statutory modification or re-enactment thereof for the time being in force. The arbitration shall be referred to one arbitrator who will be appointed by Mera Mann Foundation. The venue of Arbitration will be Mumbai.

SECTION 19 – CHANGES TO TERMS OF SERVICE

You can review the most current version of the Terms of Service at any time at this page. 

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

SECTION 20 – COMPLAINTS
